Letter of Termination
In pursuant to the Service members Civil Relief Act (50 U.S.C. Appx.500et.deq.), hereinafter referred to as the SCRA, I am terminating my automobile agreement on (Month, day, yr).
I entered this agreement on (Month, day, yr). I entered (or will enter) active duty status on (month,day,yr), and am presently assigned to (Branch & Unit).
The provisions of 50 U.S.C. Appx. Section 535 of the Service members Civil Relief Act, provides termination of the following motor vehicle agreements:
An agreement of a motor vehicle used, or intended to be used, by a service member hereby referred to as (Insert Service Member’s Name) or a service member’s dependent(s) hereby referred to as (Must be actual legal dependent(s) of service member – insert name(s) here) for personal or business transportation if;
(a) the agreement is executed by or on behalf of a person who thereafter and during the term of the agreement enters the military service under a call or order specifying a period of not less than 180 days (or who enters a period of 180 days or less than and who without a break in service, receives orders extending the period of military service to a period of not less than 180 days) or
(b) the service member while in the military service executes the agreement and thereafter receives military orders for a Permanent change of station outside of the continental United States or to deploy with a military unit for a period of time not less than 180 days.
Any such agreement may be terminated by delivery of the borrower of written notice of such termination, and copy of the service member’s military orders, to the loaner or grantee hereby referred to as (insert name of loan co.) or the assigned agent (insert name of agent). The loaner may not impose an early termination tariff or fee.
Wherefore by the application of the borrower named in the aforementioned to the court before the termination date provided in the written notice, grant relief sought by this section to the service member may be modified, as justice and equity require.
